Umber Canada Website Privacy Statement

Umber Canada respects the privacy of our customer. This Privacy Policy describes our privacy practices for the websites where it is posted. This includes mobile websites, text programs and applications. It also applies to information we collect in other places offline. Your personal information is collected, used, and disclosed by Umber Canada only in accordance with this Privacy Policy, which is based on the Canadian Standard Association Model Code for the Protection of Personal Information (CAN/CSA-Q830-96). Personal information is defined as information about an identifiable individual, with the exception of business contact information such as a job title or work-related telephone number or address.

We collect personal information about you only when you knowingly provide it, for example when you sign up for an account or order a product online. By using Umber Canada’s website, you consent to our collection, use, and disclosure of the information you provide, as set out in this Privacy Policy.

1. Collection, Use and Disclosure of Personal Information

If you request information, products, or services through Umber Canada’s website, you may be asked to provide personal information. For example, you need to register for an account with us if you want to purchase an Umber Canada product online. When you register, Umber Canada will ask for your name and contact details, as well as a username and password that you will use to log in during future visits. You may also want to provide credit card information to pay for items you order online in the future.

We collect this information to enable us to set up your account, process your orders, and supply any items you purchase. In some cases, this involves sharing your information with a third party service provider (an agent or contractor) for the purpose of fulfilling your order and providing you with the information, products or services you have requested. Should third party or contract persons be involved in Umber Canada business activities that require viewing, processing, or otherwise accessing individual personal information, those persons will be bound by agreements to maintain the privacy of Umber Canada customers.

An example of such sharing is when Umber Canada transmits credit card clearing information to a third party service provider for the purposes of charging or refunding credit cards of Umber Canada customers. Information transferred during this business operation is transmitted using a secure link employing industry standard security protocols. Only the credit card number, such information as is required to verify the validity of the credit card number, and the transaction amount is transmitted.

In addition to managing your account and maintaining responsible commercial relations with you, Umber Canada collects, uses and discloses your personal information for the following purposes:

  • To complete a transaction when you have requested our products or services (credit card numbers are used only for payment processing and fraud protection);
  • To understand and respond to our customers’ needs and requests;
  • To communicate with you generally and manage our relationship with you;
  • To recommend Umber Canada products and services that we believe will be of interest to you;
  • To process and keep track of orders and transactions, and to report back to you;
  • To train our staff to efficiently fill orders and otherwise respond to web requests;
  • To prevent or investigate a breach of contract, a data security breach, a violation of Umber Canada’s policies and procedures, or a suspected or confirmed contravention of the law; and
  • To meet legal and regulatory requirements.

However, we will not send any communications to you without either your express or implied consent.

If you wish, you can contact us or otherwise communicate with us at any time if you no longer want your personal information to be used for marketing and promotional purposes by emailing us at contact@umbercanada.ca

The personal information you provide through our site is never disclosed to third parties (other than our trusted service providers) without your consent. We do not sell, rent or trade your personal information to other organizations or companies without your explicit consent.

Note that commercial customer data is transferred by Umber Canada to secure servers in the United States for improved efficiencies. Umber Canada continues to have exclusive control over such data, however, where any personal information is stored or processed outside of Canada, it is subject to the laws of that foreign jurisdiction and may be accessible to that jurisdiction’s governments, courts, law enforcement and regulatory agencies which do not always provide the same level of protection for personal information as under Canadian privacy legislation.

2. Website Usage Information

Site Analytics: Umber Canada logs certain technical information from your computer’s Web browser when you visit us on the Internet. This information includes your IP address (a number that is automatically assigned to your computer by your Internet Service Provider), the address of the website you are coming from, the amount of time you spend visiting our website, when you visit us, the pages visited, the operating system and Web browser software you use, and, if you link to us through a search engine, the keywords you used to find our website.

The logs may contain transactional information that can be accessed only by Umber Canada and its trusted service providers, and are used solely to track visits to our site, improve its content and layout, make shopping recommendations and customize the web experience. Umber Canada will only attempt to link the logs to identifiable individuals if that is necessary for investigating a data security breach, a breach of contract, a violation of Umber Canada’s policies and procedures, or a contravention of the laws.

Cookies: A cookie is a small text file containing a unique identification number that is transferred from a website to the hard drive of your computer. This unique number identifies your computer to Umber Canada whenever you visit the Umber Canada website. Cookies are an industry standard used by most websites, and help facilitate users’ on-going access to and use of a particular site. Since cookies are only text files, they cannot run on your computer, search your computer for other information or transmit any information to anyone. We do not use super cookies or beacons that allow cross website tracking.

To help serve you better, Umber Canada sends a cookie to your computer in order to:

a. Help us remember who you are so that Umber Canada can tailor information to suit your preferences. Umber Canada uses cookies to store and sometimes track information about our users’ activities on the Umber Canada website, for example, the pages you visit most. Cookies also allow us to save passwords, billing/shipping addresses and preferences so that you will not have to re-enter them the next time you log in to your account.

b. Store your selections when you are shopping online. The most common cause of items disappearing from your shopping cart is when cookies are either not supported or disabled.

c. Measure traffic patterns. Without cookies, it could be difficult for Umber Canada to know that certain services are more popular than others. This information also helps us to understand how we can serve you better.

Cookies help us know whether or not users have seen particular content. Most browsers are initially set up to accept cookies. If you prefer, you can reset your browser either to notify you when you have received a cookie, or to refuse to accept cookies. You should understand that while Umber Canada does not require you to use cookies, certain areas of the website will not function properly if you set your browser to not accept cookies.
